Terms of Service

These Terms of Service ("Terms") are an agreement between you and POWERAI STUDIO COMPANY LIMITED (POWERAI STUDIO CO., LTD — "PowerAI Studio", "we", "us", "our"). They apply to our mobile, desktop, and web applications and to the websites at power-ai.app (each, a "Service"). By downloading, opening, or using a Service you accept these Terms. If you do not agree, do not use the Service.

2. Eligibility and age

• Our Services are not directed to children under 13. Do not use them if you are under 13.
• If you are 13 to 17, you may use our education Services (for example BandUp 9 and Smart Dictionary) with the consent of a parent or guardian where local law requires it.
• AI features powered by Anthropic Claude are available only to users aged 18 or older. If you are under 18, do not use those features.
• You must be legally able to enter into these Terms where you live.

3. Accounts

Most of our apps work without an account. Some Services (for example ĐẹpThật) let you sign in with Google or Apple. You are responsible for activity under your account and for keeping your sign-in method secure. You can delete your account at any time as described in our Privacy Policy.

4. Purchases and subscriptions

• Premium upgrades and subscriptions are sold through Google Play or the Apple App Store. The store processes payment, taxes, and receipts; we never see your card details.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal. Manage or cancel in your Google Play or App Store account settings. Deleting an app does not cancel a subscription.
• Free trials, where offered, convert to a paid subscription at the end of the trial unless you cancel before it ends. Prices and trial lengths are shown in the store before you confirm.
• Refunds are handled by the store under its own refund policy. Contact Google Play or Apple to request one; we cannot issue refunds for store purchases directly.
• For apps downloaded from the App Store, Apple's Standard End User License Agreement also applies. Apple is not responsible for the app or its support.

5. Acceptable use

You agree not to use a Service to:

• break any law or infringe anyone's rights, including privacy, publicity, and intellectual property rights;
• create or share sexual content involving minors, non-consensual intimate imagery, or sexual or nude edits of real people;
• impersonate, harass, defame, or deceive others, including with face swaps or edited photos of people who have not agreed;
• post fake reviews, paid ratings, or other people's private data (see the ĐẹpThật community rules);
• upload malware, probe or overload our systems, or bypass usage limits, paywalls, or safety filters;
• copy, resell, or reverse-engineer a Service except where the law expressly allows it.

Some Services apply automated safety checks (for example Power Swap always blocks nudity and sexual content). We may remove content or restrict access that breaks these rules.

6. Your content

You keep ownership of the photos, documents, text, reviews, and other content you create or upload ("Your Content"). Most Your Content stays on your device. Where you publish content through a Service (for example a public review), you give us a worldwide, non-exclusive, royalty-free licence to host, display, and moderate it for as long as it remains published. You confirm that you have the rights needed for anything you upload.

7. AI features and output

• AI features use cloud providers (such as Google Gemini or Anthropic Claude) and on-device models. Output can be inaccurate, incomplete, or unexpected. Review it before relying on it.
• Workout plans, diet logs, and similar output are general information, not medical advice. Consult a qualified professional before starting a new exercise or diet programme.
• Practice scores (for example IELTS band estimates) and translations are estimates and are not official results or certified translations.
• You are responsible for how you use AI output, including any edited images you share.

8. Our intellectual property

The Services, including their software, design, brand names, and logos, belong to PowerAI Studio or its licensors. We grant you a personal, non-transferable, revocable licence to use the Services on devices you own or control, in line with these Terms and the store's rules.

9. Third-party services

Services rely on third parties such as Google (Firebase, AdMob, Play Billing, ML Kit, Gemini), Apple, and Anthropic. Their terms and policies apply to their services, and we are not responsible for them. Some apps show ads served by Google AdMob.

10. Disclaimers

The Services are provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that a Service will be uninterrupted, error-free, or available in every country or on every device.

11. Limitation of liability

To the extent permitted by law, PowerAI Studio is not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to a Service is limited to the amount you paid us for that Service in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these Terms limits rights you have under mandatory consumer protection law.

12. Suspension and termination

You can stop using a Service at any time by uninstalling it or deleting your account. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue a Service. Sections 6 to 11 and 14 survive termination.

13. Changes to these Terms

We may update these Terms as our Services change. We will post the new version on this page and update the "Last updated" date. If a change is material, we will give reasonable notice, for example in the app or its release notes. Continuing to use a Service after a change takes effect means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Viet Nam. Please contact us first so we can try to resolve any issue informally. If that fails, disputes will be handled by the competent courts of Ho Chi Minh City, Viet Nam, unless the mandatory law of your country of residence gives you the right to bring a claim locally.
